The ALTWOOD® 40 Year Warranty Syntal Products (Victoria) Ltd. (hereinafter "Manufacturer") warrants that ALTWOOD® synthetic lumber is free of manufacturing defects and will not rot, splinter, check or suffer termites, carpenter ants or fungal damage for a period of 40 years. Should the product not comply with this warranty any time within 40 years from the date of purchase, the Manufacturer will, at its discretion, either provide ALTWOOD material only or reimburse the original purchase cost of ALTWOOD® material only. This warranty does not include labor, freight, installation, reinstallation, taxes or any other charge related to non-compliant product. Color is not a warranted item as some variation in color may occur. This warranty is effective only when ALTWOOD® is handled, transported, stored, applied, finished, maintained and used in accordance with the Manufacturer's written instruction. Also, application and use must comply with good standards of trade practice established within the building industry and all applicable building codes. Each purchaser of ALTWOOD® is solely responsible for determining the effectiveness, suitability and safety of any particular use or application of the product. This warranty does not cover damage of any kind resulting from faulty handling, installation, misuse, negligent maintenance, settlement or movement of walls or foundation, fire, floods, Acts of God, fortuitous events or force majeure. The Manufacturer shall not be liable for incidental, indirect, special, punitive, consequential, and exemplary or other damages of any kind whatsoever arising from any breach of this warranty. Some Provinces may not allow exclusions or limitations or incidental or consequential damages. Therefore, the above-mentioned limitations may not apply to you. This warranty may not be altered or amended except in written form signed by the Manufacturer and ALTWOOD® purchaser or original owner. No dealer, or other person or entity is authorized by the Manufacturer to make statements or representations regarding the performance of ALTWOOD® except as contained in this warranty and the Manufacturer shall not be bound by any such statements other than those contained herein. Some Provinces do not allow limitations on applied warranty. Therefore, the above-mentioned limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from Province to Province. Any claim must be made in writing to Syntal Products (Victoria) Ltd., 6722 Bertram Place, Victoria, British Columbia, Canada V8M 1Z6 within 60 days after the discovery of the defect. The Manufacturer is to be provided with a sample of the alleged defective product along with the original proof of purchase and given a reasonable time frame to investigate the claim. No repairs or replacements are to be made prior to a written notice of approval issued by the Manufacturer.
